Terms of Service

These Terms of Service ("Terms") govern your relationship with SMSC.UZ ("we", "us", or "our") when you use our website and SMS messaging services (collectively, the "Service"). Access to and use of the Service constitute your agreement to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service.

1. Subject of the Agreement

These Terms are a legally binding agreement between you ("User") and SMSC.UZ regarding your use of the SMSC.UZ platform for sending SMS messages. They define the rights and obligations of both parties.

2. Registration and Account

To use some features of the Service, you need to create an account.

• Accuracy of Information: You agree to provide true, accurate, and complete information when registering.
• Security of Credentials: You are solely responsible for maintaining the confidentiality of your login and password and for all activities that occur under your account.
• Notification of Breach: You agree to notify us immediately of any unauthorized use of your account.
• Age Restriction: The Service is available to individuals who are 18 years of age or older.

3. User Obligations

By using the Service, you agree to:

• Comply with all applicable laws and regulations of the Republic of Uzbekistan, including but not limited to laws on advertising, communications, consumer rights, and data protection.
• Not use the Service for sending spam. Spam is defined as unsolicited bulk messaging sent without the prior consent of the recipients.
• Obtain prior consent from end recipients to receive SMS messages on the topics you plan to send.
• Provide end recipients with an easy and free way to opt out of receiving your messages.
• Not use the Service for any illegal, fraudulent, or malicious purposes.
• Respect the intellectual property rights of SMSC.UZ and third parties.

4. Prohibited Actions

You are prohibited from using the Service to:

• Send Spam and Unsolicited Messages: Sending messages without the consent of recipients.
• Fraud and Phishing: Attempts to deceitfully obtain personal, financial, or confidential information.
• Distribute Illegal Content: Messages containing threats, defamation, incitement to hatred, pornography, or materials that violate the laws of Uzbekistan.
• Distribute Malware: Sending links to viruses, trojans, or other malicious software.
• Infringe Intellectual Property Rights: Using content protected by copyright without permission from the rights holder.
• Create False Identity: Impersonating another person or organization.
• Interfere with the Service: Attempts to hack, overload, or otherwise negatively impact our infrastructure.
• Infringe the Rights of Third Parties: Any actions that violate the rights of other people or companies.

5. Payment and Tariffs

• Pricing: The cost of SMS messaging services is determined by the current rates published on our website. We reserve the right to change rates, notifying you 14 (fourteen) days before the changes take effect.
• Payment Procedure: Payment for services is made by pre-funding your account balance or through other available payment systems.
• Refunds: Funds added to your balance are non-refundable, except in cases provided by the law of Uzbekistan or by decision of SMSC.UZ in the event of a technical failure on our part.
• Taxes: You are responsible for paying all applicable taxes related to the use of the Service, unless otherwise stated in the rates.

6. Intellectual Property

• Rights to the Service: All rights to the SMSC.UZ website, its design, software, underlying technologies, and content (including texts, graphics, logos) are the exclusive property of SMSC.UZ or our licensors.
• Grant of License: We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
• Rights to User Content: You retain rights to the content you send through our Service. By providing content to us for distribution, you grant us the right to use it solely for the purpose of delivering it to recipients.
• Prohibition of Copying: Copying, reproducing, modifying, distributing, or creating derivative works based on our Service without our permission is strictly prohibited.

7. Limitation of Liability

• Service Provided "As Is": We do not guarantee that the Service will be uninterrupted, error-free, or will meet your expectations.
• Message Delivery: We make every effort to ensure timely delivery of messages, but we are not liable for delays or non-delivery caused by technical issues on the part of mobile operators or recipients.
• Indirect Damages: Under no circumstances shall SMSC.UZ, its directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages, including lost profits, even if we have been advised of the possibility of such damages.
• Overall Liability: Our maximum liability to you for any claim related to the Service is limited to the amount you have paid for the services in the last 3 (three) months.

8. Termination of Use

• Termination by User: You may stop using the Service and delete your account at any time by contacting our support team. Funds in the balance are not refunded in this case.
• Termination by SMSC.UZ: We reserve the right to suspend or permanently terminate your account and deny you access to the Service without prior notice if you violate these Terms or applicable law.
• Consequences of Termination: Upon termination of this agreement, provisions that by their nature should remain in effect (e.g., Intellectual Property, Limitation of Liability, Governing Law) will continue to apply.

9. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Uzbekistan.
• Dispute Resolution: All disputes and differences arising out of or in connection with these Terms shall be resolved through negotiation. If an agreement is not reached, disputes shall be resolved in the courts of the Republic of Uzbekistan at the location of SMSC.UZ.

10. Changes to the Terms

We reserve the right to make changes to these Terms at any time. We will notify you of any material changes by posting the new version on our website or by sending a message to your email address at least 14 (fourteen) days before they become effective. Your continued use of the Service after the changes constitutes your acceptance of the new Terms.
